DisclosureIQ is a software tool that summarizes California real estate disclosure packets using artificial intelligence. It generates informational reports only.

DisclosureIQ is not legal, tax, or financial advice. It is not a substitute for:

• Professional home inspections
• Licensed real estate agent guidance
• Attorney review of legal documents
• Compliance with required state and local disclosures
• Tax or financial planning advice

You are responsible for verifying all findings against the original disclosure documents and consulting appropriate professionals before relying on this tool for real estate transactions.

Who Can Use This

DisclosureIQ is intended for:

• Real estate professionals (agents, brokers, attorneys) in California
• California consumers and investors evaluating properties

You must be at least 18 years old to use this tool. Do not use DisclosureIQ if you are a minor.

Acceptable Use

You agree not to:

• Upload PDFs you do not have the legal right to process (you own, control, or have written permission)
• Use the tool for one transaction more than once or generate high-volume reports for resale
• Attempt to reverse-engineer, scrape, or extract the tool's underlying prompts or model configuration
• Use DisclosureIQ to evade required legal disclosures or mislead buyers, sellers, or lenders
• Share your account credentials (not that we require an account in beta) or use the tool on behalf of others at scale

Violation of these terms may result in termination of your access.

AI Accuracy and Limitations

Artificial intelligence can and does make mistakes. DisclosureIQ may:

• Miss findings or misinterpret documents
• Hallucinate information not present in the packet
• Cite incorrect page numbers or document sections
• Fail to catch nuanced risks or conditional statements

You are responsible for verifying every finding against the original documents. Do not rely solely on the report for any real estate decision.

Matt Smith and DisclosureIQ are not liable for any decisions, actions, or financial losses resulting from reliance on report content without independent verification.

Beta Status and Free Service

DisclosureIQ is currently free during the private beta. This means:

• All features are unlocked at no cost during beta
• We may change features, pricing, or functionality at any time
• Paid pricing may be introduced when we exit beta
• Beta users may receive grandfathered pricing when paid tiers launch
• We do not guarantee uptime, availability, or any service-level agreement (SLA)

Use of a free service during beta is a privilege, not a right. We may discontinue beta access at any time.

Intellectual Property

Our IP

DisclosureIQ's template design, branding, software architecture, and configuration are owned by Matt Smith / Matthew Smith Realty. You may not copy, reproduce, or resell the tool itself.

Your Reports

The HTML report generated for your property is created for your use. You may:

• Share the report with your clients, colleagues, and transaction partners
• Download, save, or print the report for your records
• Reference findings in your own communications

You may not:

• Resell access to DisclosureIQ or charge clients separately for using the tool
• Claim the report as your own original work (you may co-brand it with your name and firm)

Disclaimers

No Warranty

DisclosureIQ is provided on an AS-IS, AS-AVAILABLE basis. We make no warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

Third-Party Data

DisclosureIQ pulls live data from FEMA, Cal Fire, USGS, DTSC, NOAA, DWR, CalGEM, and many other government agencies. We are not responsible for:

• Accuracy of third-party databases (they may be outdated, incorrect, or incomplete)
• API failures or unavailability of external data sources
• Changes to third-party data formats or availability

No Liability for Your Decisions

You are solely responsible for your real estate decisions. Matt Smith, Matthew Smith Realty, and DisclosureIQ are not liable for:

• Any decision to buy, sell, or lease a property based on the report
• Financial losses, missed opportunities, or business harm
• Regulatory violations or disclosure failures
• Disputes with buyers, sellers, lenders, or other parties

Limitation of Liability

To the maximum extent permitted by law, our total liability to you for all claims arising from or related to DisclosureIQ is limited to the amount you paid for the service. During beta, this is $0.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of use, even if advised of the possibility of such damages.

Governing Law

These terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding must be brought in the state or federal courts located in California, and you consent to their exclusive jurisdiction.

Changes to These Terms

We may update these terms at any time. If we make material changes, we will post the new terms and update the "Last updated" date. Your continued use of DisclosureIQ after changes constitutes your acceptance of the new terms.
