Terms of Service

By using DisclosureIQ (web at tools.matthewsmithrealty.com or the iOS / Android app) you agree to these terms. They are short and plain.

What DisclosureIQ is

DisclosureIQ is an AI-assisted disclosure-review tool operated by Matt Smith, California real estate agent (CalDRE# 02184215 ยท Responsible Broker Dennis Liebl, CalDRE# 01211348) at Luxe Places International Realty. It reads California real-estate disclosure packets, runs the text through Anthropic's Claude AI, cross-checks public hazard databases, and produces a buyer-ready report with citations.

What DisclosureIQ is not

How to use it

Run reports for properties you have a legitimate interest in (a property you own, are buying or selling, or are representing a client on). Do not upload a packet you do not have permission to share with an AI service.

What you must verify

Every finding in a DisclosureIQ report cites the original document and page number. You are responsible for verifying any finding against the original source documents before relying on it for any contract decision, repair request, or financial commitment. AI can miss things. AI can also flag things that turn out not to matter. The report is a research starting point, not a final answer.

No referral fees

DisclosureIQ does not receive any referral fee or compensation from any contractor, vendor, lender, inspector, or service provider mentioned in any report. Cost ranges in reports are informational, based on regional contractor pricing data, not bids or quotes.

AI-content disclosure

Reports are generated with Anthropic's Claude AI and reviewed by Matt Smith before being shared with clients. The "Generated by DisclosureIQ AI" watermark must remain visible on any shared or printed report, per California SB 942 and the broader AI-content-disclosure principle.

Equal Housing Opportunity

It is illegal to discriminate against any person because of race, color, religion, sex, gender identity, sexual orientation, familial status, national origin, ancestry, disability, age, marital status, source of income, military or veteran status, citizenship, immigration status, primary language, or genetic information. DisclosureIQ analyzes property facts only; it does not analyze, score, or comment on neighborhood demographics, school demographics, crime statistics, or any protected class characteristic.

Intellectual property

You retain all rights to the disclosure documents you upload and to the reports you save. DisclosureIQ retains rights to its software, system prompts, brand marks (the navy + gold "MS" monogram, the "DisclosureIQ" wordmark, the canonical report template), and aggregated anonymized usage statistics.

License you grant us

By uploading a disclosure packet, you grant Matt Smith and Anthropic a one-time, limited license to process the text for the purpose of generating your report. We do not retain rights beyond that.

Termination

You can stop using DisclosureIQ at any time. We can refuse service to any user who is abusing the tool (excessive requests, attempts to break security, harassment of the operator). Saved reports stored in your browser remain yours; you can clear them at any time.

Limitation of liability

To the maximum extent permitted by law, DisclosureIQ and Matt Smith are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service, including any decisions made based on a report. Total liability for any direct damages is limited to $100 or what you paid for the service in the prior 12 months, whichever is greater. Most users pay nothing.

Free during private beta

The service is currently free to use. If pricing is introduced in the future, the change will be announced 30 days in advance and existing free users get advance notice.

Governing law

These terms are governed by the laws of the State of California. Disputes are resolved in the state or federal courts located in Sonoma County, California, except that either party may seek injunctive relief in any court of competent jurisdiction.

Apple App Store and Google Play additions

If you obtained the app from the Apple App Store or Google Play, the additional terms required by Apple or Google for licensed applications apply (Apple's standard EULA and the Google Play Developer Distribution Agreement, respectively). In any conflict between those terms and ours, those store-required terms govern only to the minimum extent required by Apple or Google.

Changes

If we change anything material, we will update the date at the top and post a notice on the home page for 30 days.
